Today’s society is increasingly mobile. Few families spend the entire childhood of their children in the same community. Cole Miller PLLC represents political appointees, military members, and other families who may come to Northern Virginia for an expected short duration.

Cole Miller PLLC also represents families that find that must relocate from a high cost of living area to a lower cost of living area due to the financial consequences of the divorce.

The question before families with minor children who may wish to move locally or even away from Northern Virginia, is which parent will retain primary physical custody of the minor children, and what will be the other parent’s visitation with the children. A parent is always free to relocate to wherever he or she wishes. The problem arises when on parent wishes to move and take the minor children with him or her. The possible relocation often times adversely impacts the time the children with the noncustodial parent.

The impact of a parent’s relocation is very fact specific. There are likely just as many cases reported from the Virginia Court of Appeals that approve a trial court’s ruling of relocation as there are cases approving a trial court’s order that the children remain in Virginia.

The bottom line here is that matters of relocation are very fact dependent and focused on the unique circumstances of each family. It is crucial that the first hearing fully consider the case because undoing a relocation on a rehearing is not likely.

The parent who is not moving is frequently the last person to learn that his or her children may be relocated.
