All the awards of property and orders of support are worthless unless they are executed and the property is transferred to the recipient, and the support is paid to the recipient. Cole Miller PLLC works with families to ensure agreements are fulfilled and court orders obeyed.

Family support is one area in which frequent compliance problems arise. Cole Miller PLLC uses “rules to show cause” to bring a party who is disobeying an order of the court. The rule to show cause compels a party to appear before a judge and explain why his or her behavior is not contemptuous of the court’s authority and order.

When a party has failed to pay support, Cole Miller PLLC will also seek income deduction orders so that the party’s employer is subject to a court order to withhold support payments from the party’s wages and to submit the payments to the Department of Child Support Enforcement.

Matters of support, whether spousal or child, and custody/visitation are typically decided on the facts and circumstances as they exist at the time of the determination. When facts and circumstances later change, a change of support, custody or visitation may be appropriate. For instance, young children frequently benefit from visitation that occurs more frequently but is of a shorter duration. As the child matures, visitation that is longer in duration but less frequent. Cole Miller PLLC routinely handles visitation modification such as this.

Sometime families with minor children move to a new city or state. This presents new facts and circumstances that can be used to modify custody and visitation. For more information, please see “Relocation.”

Support is based upon the parties’ financial circumstances. At the time of divorce, spousal support may be set higher to allow a spouse to return to school for education and training that will lead to higher wages. Spousal support can be later modified when the spouse successfully secures that higher paying job.

Likewise, a component of child support is work-related daycare. As children mature, they may not need work-related daycare so child support can be modified.
