Negotiation/Mediation/Collaborative Divorce
Often the most cost-effective way to resolve a family law issue is through negotiation, mediation or collaborative divorce.

Negotiation - Through negotiation and skilled drafting, Cole Miller attorneys may be able to draft a Legal Separation Agreement or Property Settlement Agreement that resolves your family law issues quickly and efficiently. We also draft Premarital Agreements, Custody Agreements, and other settlement documents.

Mediation - Cole Miller attorneys often participate in mediation to resolve cases. Sometimes the input of a neutral third party facilitator will allow both parties to a family law dispute to feel like the issues that are most important to him or her have been addressed.

Collaborative Divorce - Collaborative Divorce is an option only when both parties jointly agree to forego the option of litigation in favor of the collaborative divorce process. Through collaborative efforts, parties and their counsel work together, openly and with full disclosure, to achieve fair results.

When Litigation is Necessary
Sometimes litigation is necessary. Some issues, such as adultery, protective orders, relocation in child custody matters, and separate property interests derived from inheritance or property brought into the marriage are too important not to litigate, if such issues cannot be resolved by agreement.

Cole Miller never recommends litigation for the sake of litigating and will always evaluate whether a more favorable result can be achieved through negotiation or mediation. When we decide to proceed with litigation in a case, we are strong advocates and can draw from more than 30 years of combined experience litigating divorce and family law cases.
